FALSIFIED RESERVATIONS

Any reservation obtained under false pretenses will be subject to forfeiture of all payments and cancellation without refund. Guest will not be permitted to check in.

CHECK-IN

Check-in begins at 4:00 PM Central Time. At that time, the electronic door lock will activate.

Due to our high standards of cleanliness, there may be rare occasions where the property is not ready exactly at check-in time. We appreciate your patience as we complete preparation. No discounts or refunds will be issued for delayed check-in.

CHECK-OUT

Check-out time is 10:00 AM Central Time.
No late check-outs are permitted. The electronic lock will deactivate at this time.

CANCELLATION POLICY

• Full refund of deposit if canceled 30+ days prior to arrival
• Within 30 days: deposit is non-refundable
• Any applicable add-ons (such as pet fees) will be refunded

All refunds, when issued, will take a minimum of 7–10 business days to process.

We strongly recommend purchasing travel insurance.

HURRICANE / WEATHER POLICY

Pierce Property Holdings LLC does not issue refunds due to weather, including hurricanes or tropical storms.

If a mandatory evacuation order is issued by local authorities, guests must vacate immediately. No refunds will be provided.

SECURITY DEPOSIT / DAMAGE POLICY

A valid credit card is required on file in lieu of a security deposit.

Guest agrees to be fully responsible for 100% of the cost of any damage, loss, or breakage to the property, its contents, or any associated amenities, including but not limited to the golf cart, caused by Guest or their invitees.

Guest authorizes Pierce Property Holdings LLC to automatically charge the card on file for:

• Property damage
• Missing items
• Excessive cleaning
• HOA or resort fines
• Golf cart damage or misuse
• Any other costs incurred as a result of the Guest’s stay

Failure to report damages does not relieve Guest of financial responsibility.

Guest further agrees to reimburse all associated costs, including legal fees, if collection is required.

GOLF CART POLICY

If a golf cart is provided with the property, the following terms apply:

• Use of the golf cart is entirely at the Guest’s own risk.
• The golf cart may only be operated by a valid, licensed driver over the age of 18.
• The golf cart is restricted to use within the resort/property only and may not be operated off property.
• Golf carts are strictly prohibited on Highway 98 under any circumstances.
• Guests must comply with all applicable traffic laws, rules of the road, and resort regulations at all times while operating the golf cart.

Guest agrees to be fully responsible for 100% of any damage, loss, or misuse of the golf cart during their stay. Any damage will be automatically charged to the card on file.

Liability Waiver

Guest acknowledges and agrees that operation of a golf cart carries inherent risks, including but not limited to bodily injury, death, or property damage.

By accepting use of the golf cart, Guest agrees to:

• Assume all risks associated with operation and use of the golf cart
• Accept full responsibility for any injury, death, or property damage caused to themselves, other individuals, or third-party property
• Ensure all passengers and drivers use the golf cart safely and appropriately

Guest expressly agrees to release, indemnify, and hold harmless Pierce Property Holdings LLC and the property owner from any and all claims, liabilities, damages, injuries, or losses arising from or related to the use or misuse of the golf cart, including but not limited to:

• Personal injury or death
• Injury to other persons
• Damage to vehicles, property, or structures
• Negligent or improper operation

This includes any claims resulting from actions of the Guest, their invitees, or any unauthorized user of the golf cart.

Failure to follow these rules may result in immediate termination of golf cart privileges, additional charges, or eviction without refund.

REPAIRS & MAINTENANCE

All properties are inspected regularly; however, uninterrupted operation of appliances, utilities, and amenities is not guaranteed.

Repairs will be addressed as quickly as possible. No refunds or credits will be issued for temporary outages of electricity, water, internet, HVAC, or other services.

REFUNDS

No refunds will be given for:

• Late check-in
• Early check-out
• Weather conditions
• Utility or appliance interruptions

All approved refunds will take a minimum of 7–10 business days to process.

MAXIMUM OCCUPANCY

Maximum occupancy must not be exceeded. Unauthorized guests may result in additional charges or eviction.

AGE REQUIREMENT

Primary renter must be 25 years or older unless accompanied by a parent or legal guardian who remains on the property for the duration of the stay.

UNLAWFUL ACTIVITY / PARTIES

Strictly prohibited:

• Parties or events without prior written approval
• Underage drinking
• Illegal activity

Violations will result in immediate eviction without refund and may involve law enforcement.

Guests must comply with all applicable Florida laws and local ordinances, including noise restrictions between 10:00 PM and 6:00 AM.

WEAPONS POLICY

Weapons of any kind are strictly prohibited on the property. Violation will result in immediate removal and possible reporting to authorities. Guest assumes all liability for any damages or incidents related to prohibited items.

HOA / COMMUNITY RULES

Guests must comply with all applicable HOA or community rules, including parking, trash, and amenity usage. Any fines incurred will be charged to the Guest.

PROHIBITED VEHICLES

The following are not permitted on the property or within the resort:

• RVs
• Trailers
• Motorcycles
• Unauthorized golf carts

SMOKING / PET POLICY

All properties are non-smoking. Violations will result in a $750 fine.

Pets are only permitted in designated pet-friendly properties and are subject to approval and fees. Guests are responsible for all pet-related damages.

GRILLING

Grilling is only permitted in designated areas. No grilling is allowed on balconies unless explicitly approved.

POOL & AMENITY USE

Use of pools and amenities is at Guest’s own risk. No lifeguards are on duty. Guests assume full responsibility for safety and supervision.

SURVEILLANCE

Exterior cameras may be present. Guests acknowledge no expectation of privacy in outdoor areas. Violations may result in charges or eviction.

INITIAL SUPPLIES

Starter supplies are provided, including paper goods and basic toiletries. Guests are responsible for additional supplies.

BEACH TOWELS

Guests must bring their own beach towels. Property linens may not be removed.

PARKING

Parking passes, if required, must be displayed at all times.

CHECK-OUT REQUIREMENTS

To avoid additional charges:

• Remove all trash
• Start dishwasher
• Lock all doors and windows
• Return all provided items (keys, passes, etc.)
• Leave property in good condition

Excessive cleaning or missing items will result in additional charges.

SPECIAL EVENTS

Events require prior written approval and may include additional fees.

ENTRY

Pierce Property Holdings LLC reserves the right to enter the property for maintenance, inspection, or emergencies.

LIABILITY / HOLD HARMLESS

Pierce Property Holdings LLC and property owners are not liable for injury, loss, or damage to Guest or personal property. Guests assume all risks associated with their stay.

CREDIT CARD AUTHORIZATION

Guest authorizes Pierce Property Holdings LLC to charge the card on file for any damages, violations, or fees incurred during or after the stay.

GOVERNING LAW

This Agreement shall be governed by the laws of the State of Florida.
